دعت الولايات المتحدة الأمريكية عبر مندوبتها في مجلس الأمن الدولي خلال اجتماع عقده المجلس بتاريخ 30 تشرين الثاني 2021 إلى انشاء آلية قضائية دولية لمحاسبة نظام الأسد عن الجرائم التي ارتكبها بحق الشعب السوري منذ عام 2011، وهو ما أيّده مندوبو العديد من الدول الأعضاء في موقفهم الرافض لإفلات النظام المجرم من العقاب.
تشيد الحكومة السورية المؤقتة بهذا التوجه وتؤكد على ضرورة اتخاذ خطوات دولية جادة لتحقيق العدالة الجنائية عبر إيجاد آلية قضائية خاصة تضمن محاسبة النظام وكل المتورطين في الجرائم المرتكبة بحق الشعب السوري.
تعتبر الحكومة السورية المؤقتة تلك الدعوات بمثابة خطوة أولية وبسيطة في الاتجاه الصحيح نحو الانتصار للعدالة والانتصار للضحايا من المجرمين كما حصل عندما انتصر المجتمع الدولي للعدالة عبر محاكمات يوغسلافيا ورواندا وسيراليون وغيرها.
ومن هنا نجدد مطالبنا في إنشاء آلية قضائية جنائية دولية لملاحقة مجرمي الحرب في سوريا كعملية لابد منها لأنها تصب في حماية القيم الإنسانية ومصالح المجتمع الدولي، وتشكل في الوقت نفسه رادعاً لكل المجرمين على المستوى الدولي.
كما نعبر عن شعورنا بالفخر من الموقف الثوري الشجاع والصادق لكل من الناشط الحقوقي عمر الشغري والصحفية وعد الخطيب والمحامي إبراهيم علبي عن شهاداتهم أمام مجلس الأمن الدولي والتي استعرضوا من خلالها جرائم نظام الأسد بحق السوريين مطالبين بوقفها وتأمين الحماية للشعب السوري ومحاسبة المجرمين.
وفي النهاية، لابد من التأكيد على أن تبلور موقف دولي حاسم والعمل على إيجاد آلية قضائية دولية تتمثل في إنشاء محكمة جنائية خاصة بسورية تضمن ملاحقة نظام الأسد المجرم وتمنع إفلات المجرمين من العقاب، وهو ما يضمن استعادة الثقة بالعدالة الدولية وتعزيز أمن وسلامة البشرية وتحقيق الاستقرار الدولي.

Statement
On the International Attitude Regarding the Accountability of the Syrian Regime
Through its representative in the UN Security Council, during a meeting held by the Council on November 30, 2021, the US called to establish an international judicial mechanism to hold the Assad regime accountable for the crimes, which it has committed against the Syrian people since 2011. Many delegates of Member States supported in their attitude on criminal regime impunity
The Syrian Interim Government commends this trend and stresses the need to take serious international steps to achieve criminal justice by creating a special judicial mechanism that ensures accountability of the regime and all those involved in crimes committed against the Syrian people
The Syrian Interim Government considers these calls as an initial and simple step in the right direction towards victory for justice and victory for the victims against criminals, as happened when the international community won justice through the trials of Yugoslavia, Rwanda, Sierra Leone and others
Hence, we renew our demands to establish an international criminal judicial mechanism to prosecute war criminals in Syria as an inevitable process because it serves to protect human values, the interests of the international community and at the same time constitutes a deterrent to all criminals on the international level
We also express our feeling of pride in the brave and honest revolutionary attitude of the human rights activist Omar Al-Shughari, the journalist Waad Al-Khatib and the lawyer Ibrahim Oulabi for their testimonies in front of the UN Security Council. Where they reviewed the crimes of the Assad regime against the Syrians, demanding their cessation, ensuring protection for the Syrian people, and holding the criminals accountable
In the end, it must be emphasized that a decisive international position should crystallize; and make endeavor to find an international judicial mechanism represented in the establishment of a criminal court for Syria to ensure the prosecution of the criminal Assad regime, and prevent impunity for criminals. That ensures the restoration of confidence in the International justice, the enhancement of human security and safety and the achievement of international stability
