بعد تأخر جهود تحقيق العدالة لسنوات طويلة، تقدمت اليوم كل من هولندا وكندا بدعوى مشتركة أمام محكمة العدل الدولية ضد نظام الأسد المجرم بسبب الممارسات الوحشية التي ارتكبها بحق الشعب السوري منذ عام 2011 والتي تشكل انتهاكاً فاضحاً لاتفاقية مناهضة التعذيب المعتمدة من الجمعية العامة للأمم المتحدة عام 1984.

على مدار أكثر من اثني عشر عاماً ارتكب نظام الأسد جرائم قتل وتعذيب ممنهج في سجن صيدنايا وأقبية الأفرع الأمنية وفقاً لما وثقته اللجان الدولية والمنظمات الحقوقية الدولية والوطنية وجميع نشطاء وناشطات حقوق الانسان؛ حيث تم الكشف عن بعض الأهوال التي يتعرض لها المعتقلون في مسالخ النظام البشرية، وهي جزء يسير فقط من أساليب التعذيب والممارسات اللاإنسانية كسياسة حكومية ممنهجة ضد المغيبين في معتقلات الأسد.

ورغم الجهود الدولية لوقف ممارسات التعذيب والقتل والكشف عن مصير المعتقلين، تجاهل نظام الأسد بكل صلف تلك المطالب واستمر في اجرامه دون أدنى احترام للاتفاقيات والمواثيق الدولية.

وتأتي هذه الدعوى الدولية لتكون بمثابة رسالة واضحة في دلالاتها ومعانيها بأن كل محاولات تأهيل النظام المجرم والتطبيع معه، لا يمكن أن تمحو سجله الإجرامي المشين أو تحميه من الملاحقة الجنائية.

إن الحكومة السورية المؤقتة ترحب بالمساعي القضائية الهامة التي بذلتها هولندا وكندا لإيصال ملف جرائم التعذيب التي ارتكبها النظام السوري إلى محكمة دولية تابعة للأمم المتحدة، كما تبدي الحكومة استعدادها لتقديم كل ما تستطيع للجهود التي تبذلها الدول والمنظمات الدولية لدعم مسار العدالة والمحاسبة والكشف عن الجرائم وجمع أدلتها وإنهاء ظاهرة الإفلات من العقاب.

كما ندعو المجتمع الدولي إلى ممارسة كل أشكال الضغط على النظام المجرم لاتخاذ التدابير التي تؤدي إلى وقف ممارسات التعذيب والقتل في مراكز الاحتجاز، والكشف عن مصير المعتقلين وإطلاق سراحهم، كما نحث على ضرورة الإسراع في خطوات تحقيق العدالة عبر تشكيل محكمة جنائية خاصة لملاحقة مسؤولي النظام عن كافة الجرائم التي ارتكبوها بحق الشعب السوري.

On Submitting a Case to the ICJ against the Assad Regime

After a long time of escaping justice, today the Netherlands and Canada submitted a joint case to the International Court of Justice against the criminal Assad regime for the brutal crimes it committed against the Syrian people since 2011, which constitute a flagrant violation of the Convention against Torture approved by the United Nations General Assembly in 1984.

For more than twelve years, the Assad regime has committed systematic crimes of murder and torture in Sednaya prison and the basements of the security branches, as documented by international committees, international and national human rights organizations, and all human rights activists. Some of the horrors that detainees are subjected to in the regime's human slaughterhouses were revealed, and it is only a small part of the methods of torture and inhumane practices as a systematic government policy against the disappeared in Assad's detention centers.

Despite the international efforts to stop the practices of torture and killing and to reveal the fate of the detainees; the Assad regime arrogantly ignored these demands and continued its crimes without the slightest respect for international conventions and covenants.

This international case comes as a clear message in its implications and meanings that all attempts to rehabilitate and normalize with the criminal regime cannot erase its disgraceful criminal record or protect it from criminal prosecution.

The Syrian Interim Government welcomes the important judicial efforts made by the Netherlands and Canada to refer the file of torture crimes committed by the Syrian regime to an international court of the United Nations. The government also expresses its willingness to provide all it can for the efforts made by states and international organizations to support the course of justice and accountability, uncover crimes, collect evidence, and end impunity.

We also call on the international community to exert all forms of pressure on the criminal regime to take measures that lead to stopping torture and killing practices in detention centers, reveal the fate of the detainees and release them. We also urge the need to expedite steps to achieve justice by forming a special criminal court to prosecute regime officials for all the crimes they have committed against the Syrian people.
